Hi
Can anyone suggest a good solicitor in the Paphos area, I want to sue a company.

David I fear you will not get many replies. There are a very few honest lawyers in Paphos, none seem particularly reliable to pursue commercial litigation.

When you find your lawyer please be aware it will take 2 to 3 years to get your problem to court, that is if the company involved does not use delaying tactics.

I have taken several cases to civil court in the UK and even challenged government by way of judicial review. That was complicated enough, but when faced with developer default here, decided it was better to find other avenues. My view is Cypriot justice is a very last resort. :rocky

This a really difficult one to answer.

For every recommendation you get there will be no end of people who would tell you not to use them with a barge pole. I have seen it before where someone has said to use so and so as they are amazing, where you know of others who have had issues further down the line and discovered that the lawyer wasn't what they thought at all.

The issue is that you never really know whether they are any good until something goes wrong. Until then you have to assume that everything went well and in your interests, but you could be way off the mark.

Not always easy to find out, but be very aware of a lawyer's vested interests as they may well not tell you but still take your business. This is especially relevant in anything to do with building and construction.

There are two lawyers that I have used successfully, one of whom I am using for another project now. My other lawyer has had negative feedback from others but did exactly what I asked of him, but I would not be willing to recommend either of them as it really does depend on precisely what you need them to do.

You say that you want to sue a company. If this is a developer or someone connected to the industry then I suspect that you are on a hiding to nothing.

If you want to sue a company in Paphos - get a lawyer from another city in Cyprus. Preferably one as far away from Paphos as possible.

The company are based in Limassol, It's a window company.

We had the windows supplied and installed ( Alli sliders) by this company over 4 months ago. Two weeks after they were installed the rain started, firstly the drainage was not drilled out and the water filled the tracks and steamed down the internal walls causing damage to walls, floors and furniture. The water was also entering at the sides & bottom of the windows, not enough silicone used. We were wiping the mould away every two days. It has ruined most of our blinds. I have removed some of the plasterboard insulation as the mould started growing on the rear of the boards. My wife has had to cancel a Yogo retreat here and pay everyone back their deposits ( over 2k ) To add to all this the windows were measured wrong, some windows having 20mm gap filled with silicone around them! I will have to get all the outside rendered and plant on plasterboard on the inside. We do owe a small amount but it won't cover all this. Our place is in a real mess and I have suffered really bad asthma and had to attend Paphos hospital a few times. Yesterday I was told the company are going to come back next month and take out all the windows and doors and reinstall them. Will that happen?? he has said that a number of times.

Before going as far as a lawyer, which will take you years with no guarantee of a win, you could wait to see if they come back and sort it and, if they don't, go and speak to the Cyprus Consumers' Association - http://www.cyprusconsumers.org.cy/en/ - who are usually very good at sorting these issues out. If that works it will be an awful lot quicker (not to mention cheaper).

If you were aware of the faults & still paid for the work, then I would say your case is unfortunately destined to fail.
Bite the bullet, get the work done properly & save the additional time & money on your intended court action is my advice.

I don't want to get PP into any legal problems, so I would ask around to get other opinions of the above lawyer. I believe Nigel Howarth who has the property section on Eastern Forum has a list of which Bar Association lawyers have had the most complaints made against them. Some Paphos lawyers are in pole position.

It would appear that PP have a 'legal eagle' at your/our disposal (refer Legal Advice section).

His name is Haris Kalogirou & he has posted to the effect that he will answer any questions.

What is not explained is the basis of his relationship to PP, is he a sponsor, selected by the Moderator(s), or simply touting for our business?

I bought a property in 2011 and Mr K was acting for the vendor. Several weeks after the sale I went to Land Registry to collect the deeds. There were missing at LR and a full search revealed Mr K had taken them quite some days before. He was not keen on returning our deeds to LR and we had to go to his offices and wait while his staff found them. To this day I have no idea why he took the deeds and what business it was of his, once the title had changed to my name. The only answer I got was that simple mistake and one that went unreported for many days. So a good question might be "can lawyers draw deeds out of Land Registry which have been paid for by buyers who are not their clients?"

Strange behaviour indeed!
If "Mr.K" is code for Kalogirou, why would anyone not have doubts about using his services as offered to this forum?
