 Post subject: The value of Title Deeds

Someone said in conversation that even if you state your intention in your Will, without you holding the Title Deeds, the property will automatically revert to the developer upon your demise.
I had relaxed on the issue of Title Deeds, however, this has woken me up to the danger of not getting them before my demise!
Is this fact or fiction?

Technically (and probably legally too, but I am not a lawyer),as I understand it, if you do not have your title deeds, you do not own the property. The legal outright owner is whoever is named on the title deeds. However, if you have a Specific Performance Contract or a Deed of Assignment, and if it was registered at the Land Registry, then your interest in the property is protected and your will is simply passing on the benefits accrued under this deed, not passing on the title to your property.

If you applied for your deeds under the 2015 "Hidden Mortgages" Law, and have heard nothing for a while, then it may be worth your while to visit LR and check to see if there is a hold-up/problem that needs your attention.

No I hadn't heard Topgun and it's a shame as it was a very helpful site but if neither are operating it must have happened very recently as their are posts by Nigel Howarth this week.

I stand corrected, but one out of two ain't bad!

I made the mistake of assuming he had followed through with his expressed intent, when he told us at an investor seminar last year he was 'retiring' from his advisory role.

Just goes to show, to get close to the truth on any particular subject, you should ask the same question of at least three different people, even when as it were, you heard it from the horses mouth. :gossip
